Weather Delays & Site Conditions

Paving and construction services are highly dependent on weather and site conditions. Mierzwa Paving shall not be held responsible for delays, rescheduling, or interruptions caused by weather conditions, including but not limited to rain, extreme temperatures, frost, excessive moisture, or other adverse conditions that may impact the quality or safety of the work.

If weather or site conditions are deemed unsuitable, Mierzwa Paving reserves the right to postpone or suspend work until conditions improve. Such delays do not constitute a breach of contract and do not entitle the customer to refunds, discounts, or damages.

Additionally, unforeseen site conditions such as unstable subgrade, drainage issues, hidden utilities, or surface deterioration may require changes to the scope of work. Any additional work required due to these conditions may result in additional costs and schedule adjustments, which will be communicated to the customer.

Material Availability & Price Fluctuations

Pricing and scheduling for paving services are subject to the availability of materials, including asphalt, aggregates, and related products. Due to market conditions beyond our control, material costs and availability may fluctuate.

Mierzwa Paving reserves the right to adjust project timelines or pricing in the event of:

Material shortages
Supplier delays
Fuel cost increases
Manufacturer or supplier price changes

If material availability or pricing changes significantly after an estimate is provided but before work begins, Mierzwa Paving will notify the customer and may revise the estimate or reschedule the project accordingly. Such changes do not constitute a breach of agreement.

Project Scheduling

Project start dates and completion timelines are estimates only and are not guaranteed. Scheduling may be affected by weather conditions, material availability, equipment issues, prior project delays, or other circumstances beyond our control.

Mierzwa Paving is not liable for any damages, losses, or expenses resulting from delays, including but not limited to lost use of property, business interruption, or inconvenience.
